Conscription commissions
Conscription commissions are established for the conscription period by the decision of local executive bodies in composition established by Article 28 of the Law of RK "On Military Service and Status of Servicemen". The commissions can also include representatives from government agencies and public associations. Numerical composition of a conscription commission should be odd.
Regional (city of republican significance and capital) conscription commission:
- manages and controls the activities of district (cities of regional significance) conscription commissions;
- checks the correctness of draft deferment and exemption provision to citizens;
- examines complaints and requests of citizens regarding decisions of district (cities of regional significance) conscription commissions;
- cancels decisions of district (cities of regional significance) conscription commissions.
Physical evaluation boards conducting medical evaluations are established on an ongoing basis in regions, cities of republican significance, capital, cities and districts based on decisions by local executive bodies to evaluate degree of fitness of the following categories for military service:
- draftees;
- individuals eligible for military service and drafted for military duty;
- citizens drafted for military service under contract; enrolling to military educational institutions, to military training divisions or to specialized organizations of the Ministry of Defense.
Based on the results of medical evaluation, a district (cities of regional significance) conscription commission makes a decision in respect of a citizen enrolling to a military educational institution (to military training division) on his referral to take entry examinations or refuses to provide a referral.
Following the results of medical evaluation, a district (cities of regional significance) conscription commission makes one of the following decisions in respect of a draftee:
- subject to draft to military service;
- defer from the draft to military service;
- exempt from the draft to military service;
- grant relief from military service.
A decision made by a conscription commission is announced to a draftee within one day and its copy can be issued on request.
A citizen can appeal a decision made by a conscription commission in a court or in a regional (city of republican significance and capital) conscription commission. Preliminary appeal to a regional (city of republican significance and capital) conscription commission is not a mandatory condition to appeal to court.
In case of concurrent consideration of appeals at a regional (city of republican significance and capital) conscription commission and at court, a regional (city of republican significance and capital) conscription commission ceases considering an appeal prior to the entry into force of court ruling.
A court ruling entered into force is mandatory for execution by relevant conscription commissions.
Heads of authorized bodies rescind a decision of conscription commission on drafting of citizens not fit for military service for health reasons and return them to conscription commissions with provision of substitute before swearing-in ceremony.
Physical evaluation boards
- Physical evaluation boards are established under conscription commissions for medical evaluation of draftees and citizens drafting to military service under contract, to military educational institutions (to military training divisions).
- Based on medical evaluation of draftees and citizens drafting to military service under contract, physical evaluation boards issue statements on fitness for military service.
- Medical evaluation procedure and composition of physical evaluation board are specified by the Rules for military medical evaluation.
