Trademark, service mark (hereinafter - trademark) is a designation registered in accordance with the Law of the Republic of Kazakhstan "On Trademarks, Service Marks and Appellations of Origin of Goods" or protected without registration under international treaties to which the Republic of Kazakhstan is a party, which serves to distinguish goods (services) of certain legal entities or individuals from similar goods (services) of other legal entities or individuals.

The use of a trademark, geographical indication or appellation of origin is the affixing of a trademark, geographical indication or appellation of origin to the goods and services in respect of which they are protected, their packaging, manufacture, use, importation, storage, offer for sale, sale of goods bearing the trademark, geographical indication, appellation of origin or name of the place of origin of the goods, their use in signs, advertising, printed materials or other commercial documents, and any other manner of putting them into circulation.

Means of individualizing participants in civil transactions, goods, works or services are as follows

It is not allowed to register as trademarks those consisting exclusively of non-distinctive designations

It is not allowed to register as trademarks or their elements the designations
