Inclusion in the customs register of intellectual property objects

How to get the service online:

1. Log in on the Portal and click "Request Online" button (to get the service you need to be registered on the keden.kgd.gov.kz website).
2. Fill in the required fields on the keden.kgd.gov.kz website and sign a request using DS (digital signature). Track the status of the application in the personal account on the “keden.kgd.gov.kz” portal.

The following documents shall be attached to an application in the electronic format:

1. Documents confirming the existence and ownership of intellectual property rights (a certificate or an agreement on the transfer of rights, including a license agreement, or an extract from the State Register of Intellectual Property Objects of the Republic of Kazakhstan, or a certificate (extract) on the legal status of a trademark under international registration, or other documents that the right holder or another person representing the interests of the right holder may submit to confirm their rights to intellectual property objects).
2. A power of attorney issued by the right holder to the person representing his (or her) interests.
3. Images of distinguishing features of original goods containing intellectual property objects, and of goods containing signs of infringement of intellectual property rights.
4. An undertaking by the right holder or another person representing the right holder’s interests to compensate the declarant and other persons for any property damage that may arise in connection with the suspension of the release of goods containing intellectual property objects that are presumed to infringe intellectual property rights, in cases where it is subsequently established that such goods do not infringe intellectual property rights.

A liability insurance contract of the applicant against damage caused to other persons, concluded electronically through the insurer’s online platform and/or the online platforms of other organizations. The insurance amount shall not be less than 1,000 times the monthly calculation index established for the relevant financial year under the Law on the Republican Budget.
